Terms & Condition

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Boot & Boost Entrepreneur LLP ("TextileTone", "we", "us" or "our"), the operator of the TextileTone platform available at textiletone.in.

If you are using TextileTone on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms, and the term "you" shall refer to that organisation.

If you do not agree to these Terms, please discontinue use of the platform immediately. We reserve the right to refuse service to anyone for any reason at any time.

TextileTone is an online platform that enables textile designers, manufacturers and quality control professionals to upload fabric images, analyse dominant colors, match shades, redesign patterns and export color data in multiple formats.

Our services include, but are not limited to: fabric color extraction using K-Means clustering, CIEDE2000-based shade matching, textile redesign tools, palette generation and color export utilities.

We may introduce, modify or discontinue features at any time without prior notice. We are not obligated to provide any specific feature or maintain any minimum level of service availability.

To access certain features of TextileTone, you may be required to create an account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete.

You are solely responsible for all activities that occur under your account. You must notify us immediately at bazar.kr07@gmail.com if you suspect any unauthorised use of your account or any other breach of security.

We reserve the right to suspend or terminate accounts that provide false or misleading information, or that violate these Terms in any manner.

You must not use our platform in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect. Violation of this policy may result in immediate termination of your account and access to the platform.

The TextileTone name, logo, website design, source code, algorithms, databases, user interface layouts and all associated intellectual property are owned by or licensed to Boot & Boost Entrepreneur LLP and are protected under Indian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform for its intended purpose only. You may not copy, modify, distribute, sell, reverse engineer or create derivative works from any part of our platform without our prior written consent.

Content you upload to TextileTone (such as fabric images) remains your property. By uploading, you grant us a limited licence to process that content solely to provide the services you requested.

Your use of TextileTone is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at textiletone.in/privacy.php to understand our data collection and usage practices.

By using the platform, you consent to the collection, processing and use of your information as described in the Privacy Policy. We implement industry-standard security measures to protect your data, but we cannot guarantee absolute security.

Engaging in any of the activities listed below will result in immediate account termination and may expose you to legal liability. We reserve the right to report any illegal activity to the appropriate authorities.

TextileTone is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that (a) the service will be uninterrupted or error-free; (b) the results obtained from using the service will be accurate or reliable; or (c) any errors in the software will be corrected.

Color analysis results are generated algorithmically and may not perfectly match physical color standards such as Pantone or physical dye lots. Always verify critical color decisions using physical samples and professional calibration tools.

To the maximum extent permitted by applicable law, Boot & Boost Entrepreneur LLP and its directors, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, goodwill or other intangible losses.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or ₹500 (Indian Rupees Five Hundred), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Our platform may contain links to third-party websites or services that are not owned or controlled by TextileTone. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party websites or services.

We strongly advise you to read the terms and privacy policies of any third-party websites you visit. Your interactions with third-party services are governed by those parties' own terms.

We may suspend or terminate your account and access to TextileTone at our sole discretion, without notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers and limitations of liability.

You may delete your account at any time by contacting us at bazar.kr07@gmail.com. Deletion of your account does not affect any obligations you incurred prior to termination.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts of Varanasi, Uttar Pradesh, India shall have exclusive jurisdiction over any disputes arising from these Terms.

In the event of any dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to arbitration under the Arbitration and Conciliation Act, 1996 of India.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page.

For significant changes, we will make reasonable efforts to notify you by email (if provided) or by placing a prominent notice on our platform. Your continued use of the platform after any changes constitutes acceptance of the new Terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to the revised Terms, please discontinue use of the platform.
